I am delighted to endorse pro-gun attorney, Maria Battista, for Superior Court.
When Judge Daniel McCaffery was elected to the PA Supreme Court, his seat on the Superior Court became vacant. A special election to fill that position will be held on November 4th.
We must elect a pro-Second Amendment judge for this vacant seat, and gun owners have a great candidate in Maria Battista.
Maria Battista lives in Clarion County, PA. She has more than 15 years of legal experience in civil, criminal, and administrative law. She is also a former Assistant District Attorney.
Important for gun owners, Maria Battista rated herself as a “strict constructionist” in how she interprets the Constitution on her GOA candidate survey. She also identified Antonin Scalia as the Supreme Court Justice she most identifies with in her judicial philosophy.
Here is what Maria Battista has to say in her own words regarding our God-given rights:
I am incredibly grateful for the support and endorsement of the Gun Owners of America. As a judicial candidate for Judge of the PA Superior Court, I am committed to upholding our duly enacted laws as written and the Pennsylvania and U.S. Constitutions as intended. Both the Second Amendment to the U.S. Constitution and Article1, Section 21 of the Constitution of the Commonwealth of Pennsylvania provide for the right to bear arms. The U.S. Supreme Court in New York State Rifle and Pistol Association v. Bruen affirmed that the Second Amendment conferred the individual right to keep and bear arms and more recently, the PA Superior Court, on June 23, 2025, issued an opinion in Commonwealth v. Sumpter, also acknowledging that the right to keep and bear arms is a fundamental right.
Friend, we must elect strong, constitutionalist judges on the Superior Court. The 15-member Court is one of two appellate courts in Pennsylvania and it hears criminal, family, and civil cases on appeal from the Court of Common Pleas.
And while the Commonwealth Court gets lots of attention for its impact on gun owners, the Superior Court is also extremely important for our God-given rights. For example, recently the PA Superior Court issued a decision declaring Philadelphia’s open carry licensing requirement unconstitutional.
